BY USING the www.vescense.com website, YOU AGREE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.  If you do not agree to be bound by the terms of this Agreement, you will not be able to proceed with the customer registration process or use the service.

You understand that VESCENSE cannot and does not guarantee or warrant that files available for downloading from the website will be free of infection or viruses, worms, Trojan horses, time bombs, cancelbots or other computer programming routines that are intended to intercept or expropriate any system, data or personal information, or to damage, detrimentally interfere with any system. You are responsible for implementing sufficient firewalls, virus protections and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the website for the reconstruction of any lost data.


  • Online Conduct.

    1. VESCENSE Advocates and Customers agree that they are solely responsible for the content or information they publish, post or display on the website, or transmit to other Advocates and Customers.  You agree to use the Service in a manner consistent with any and all applicable laws and regulations that you will not post any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law. You agree that you will not post on the website, or transmit to other Advocates and Customers or employees, any defamatory, inaccurate, abusive, obscene, profane, offensive sexually oriented, threatening, harassing, racially offensive, or illegal material, comments, suggestions, photos, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). Please notify us of any material contained on the website that you believe infringes these rules by sending an email to compliance@vescense.com
    2. You will not harvest or collect personal information about Advocates or Customers whether or not for commercial purposes, without consent. You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the website or its contents.  You will not "frame" or "mirror" any part of the website, without our prior written authorization. You also shall not use metatags or code or other devices containing any reference to VESCENSE.com or the website in order to direct any person to any other website for any purpose.  You will not modify, adapt, sub-license, translate, sell, reverse engineer, decipher, de-compile or otherwise disassemble any portion of the website or any software used on or for the website or cause others to do so.
    3. You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
    4. We reserve the right to terminate or restrict your access to the website if, in our opinion, your use of the website may violate any laws, infringe upon another person's rights or violate the terms of this Agreement.

    VESCENSE expends great efforts to provide only high quality web resources that are valuable and appropriate. However, because VESCENSE does not have control over the changing nature of content on sites that may be listed in its links, VESCENSE lists third party sites for use at the user's risk and explicitly disclaims any responsibility for the accuracy, content, or availability of information the resources may contain. Subsequently, VESCENSE does not warrant or guarantee that information from any listed site will not contain material that is inaccurate, or which some individuals may deem inappropriate or objectionable.

    1. Accounts and Password.

    1. You are solely responsible for all activities within your account under your password and VESCENSE identification number. Your password should be treated with care and should not be disclosed to anyone. You cannot use your password or anyone else's password for any unauthorized purpose. You indemnify VESCENSE and its staff from all claims and liabilities made by a third party resulting from all activities incurred within your account. 
    2. In consideration of your use of the website you agree to: (i) provide true, accurate, and current and complete information about yourself or your organization as prompted by the website (the "registration information"); and (ii) maintain and update the Registration Information to keep it true, accurate, current and complete. You will cooperate as fully as reasonably required in VESCENSE defense of any claim. VESCENSE reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of VESCENSE.

    For Advocates, your user engagement includes a revocable right to access and use certain trade secret, confidential, and proprietary business information, which includes, without limitation, sales organization information, i.e., information compiled by VESCENSE that discloses or relates to all or part of the Advocates sales organization, including, without limitation, Advocate lists, and all Advocate contact and business performance information. You acknowledge that VESCENSE is the exclusive owner of all such confidential information and agree to maintain all confidential information in strictest confidence and to use it only as authorized by VESCENSE. You agree not to compile, organize, access, create lists of, or otherwise use confidential information except as authorized by VESCENSE under the Advocate Policies and Procedures, as amended.


    1. Linking and Framing Policy.

    1. This website may contain links to other websites operated by third parties. The linked sites are not under our control and we are not responsible for their content. Such links do not imply our endorsement or guarantee of the products, information, or recommendations provided by any third party site.  The third party site may have a privacy policy different from ours and may provide less security than this website. We disclaim all liability with regard to your access to such linked websites. We provide links to other sites as a service to users, and access to any other sites linked to this website is at your own risk.
    2.     1. Governing Law, Jurisdiction and Venue.

    This Agreement and access to the website shall be governed by and construed in accordance with the laws of Hong Kong, exclusive of its choice of law rules and matters affecting copyrights, trademarks and patents under Hong Kong law.  You hereby irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the courts of the state of Hong Kong for any litigation arising out of or relating to use of the website or purchases of services made through the website (and agree not to commence any litigation relating thereto except in such courts).     Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

    VESCENSE Advocate


    When you decide to become a VESCENSE Advocate, or when you register to shop online as a customer, we will collect Personal Information (such as name, address, email address, and telephone number). This Personal Information is securely stored in your VESCENSE contact file. You will be assigned an identification number and you will select a password which will be necessary to gain entrance to the website and to access your Personal Information.  


    You expressly consent to our communicating with you about VESCENSE using the information you provided to us. You also attest that you have the legal authority over any telephone number you provide to us and can provide us with the authorization to contact you.     We use the information that is collected about you for a variety of purposes, such as confirming and fulfilling orders, referrals to service partners, adding you to our email subscription list, providing your name to a VESCENSE Advocates in connection with potential interest in VESCENSE products or the business opportunity. We also use the information in analyzing trends and statistics, enhancing the operation of the website.  


    From time to time you may voluntarily provide Personal Information to complete questionnaires or to participate in contests, polls or personalized assessments. We use this information to improve our products and services. We may also use your Personal Information to provide you newsletters and other marketing information we think would be of particular interest to you concerning things such as new products or website features. But you always have the opportunity to let us know if you do not wish to receive unsolicited promotional materials from us, and we will make every reasonable effort to honor such requests.


    Your mentoring sales organization acts as a support network, providing advice, assistance and information to assist you in building and maintaining a successful VESCENSE business. Therefore, VESCENSE will use Personal Information in developing genealogy reports and will share Personal Information with your upline sales organization. They have agreed that such information is confidential, and not to share your information with any non-affiliated third parties, and are obligated to observe the intent of this Privacy Policy.


    We work with affiliated businesses we do not control, such as product and service sellers on our website. We share customer information related to any transactions between you and that third party.


    We may share Personal Information you provide online with other VESCENSE-affiliated entities and/or trusted business partners with whom we collaborate. We may develop business relationships in the future with business partners. In these instances, we may share or otherwise allow access to information that is collected about you that will enable our business partners to contact you regarding products and services that may be of interest.     Refund Policy


    Subject to your statutory rights under regional Consumer Law, all creations are final sale. Because all VESCENSE products need to be stored at a specific temperature and are hand packaged, we do not accept returns nor exchanges except as required by law. Returns are not suitable due to health protection and hygiene reasons,. If the items sent do not conform to your order, or should they be defective, please email us at help@vescense.com.


    In the case that you were shipped the wrong item, you are eligible for an exchange . To be eligible for an exchange of equal or lower value, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging except for removal of the blotting wrapper paper. You’ll also need the receipt or proof of purchase.

    Damages and issues

    Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

    If a product is delivered damaged or is defective, then you should contact our team for a return.


    To start a return, you can contact us at help@vescense.com. If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. A

    refund will be given without undue delay, and in any event within 14 days beginning with the day on which VESCENSE agrees that the consumer is entitled to a refund. This right is limited to 30 days from the date the consumers take ownership of the goods.


    Unfortunately, we cannot accept returns on sale items or gift cards.


    Exchanges

    The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.


    Refunds

    We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.
